The services of BOGNER Academy GmbH offer the possibility to discover content and videos on the subject of DeFi, short for decentralized finance.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">1.2. The use of the services is subject to these Terms of Use.<\/span><\/p><p><b>2. Registration<\/b><\/p><p><span style=\"font-weight: 400;\">2.1. For the use of certain offers of BOGNER Academy, registration is required.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">2.2. Registration as well as the use of a user account are free of charge unless otherwise indicated.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">2.3. Registration is permitted upon providing the required form data for persons who are at least 18 years old and have full legal capacity, as well as for legal entities and partnerships.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">2.4. Only one natural person may register per user account (e.g. no joint accounts for spouses, company accounts, or shared access).<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">2.5. After providing the required data, an activation email will be sent to the email address provided by the User.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">2.6. The activation link is valid for a limited time. If the User does not complete the activation within the specified period, the registration will be canceled free of charge.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">2.7. The User confirms the registration via the confirmation link in the registration email sent. Once registration is completed, the Terms of Use for services requiring registration with BOGNER Academy are deemed concluded.<\/span><\/p><p><b>3. User Account<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">3.1. Users can log into their account at <\/span><a href=\"https:\/\/bognerdefiacademy.com\/es\/\"><b>www.bognerdefiacademy.com<\/b><\/a><b>.<\/b><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">3.2. The login credentials for using the user account are the access identifier (profile name) and the personal password, which can be changed by the Users at any time.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">3.3. Users may modify the data they have provided at any time in the profile settings.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">3.4. Users may delete the account at any time using the designated account settings.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">3.5. Multiple accounts with the same email address cannot be created.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">3.6. With their user account, the User gains access to the free content of the portals.<\/span><\/p><p><b>4. Technical Requirements<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">4.1. To use the services of BOGNER Academy, you need an internet-enabled device.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">4.2. To use the portals, an average internet bandwidth suitable for video streaming (at least 10 Mbit\/s) and a stable internet connection are required.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">4.3. The portals can be used with common browsers such as Google Chrome, Mozilla Firefox, and Microsoft Edge. In case of display problems on the device, the following browser is recommended: Google Chrome.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">4.4. The portals can also be accessed using a mobile browser, although this is not recommended.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">4.5. To access certain contributions or teaching materials as \u201cePapers\u201d or PDFs, the latest version of Adobe Reader by Adobe Systems Inc. or a comparable program capable of viewing and saving PDF documents is required.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">4.6. Users are responsible for setting up the above-mentioned technical requirements. These are not included in the services of BOGNER Academy. Any costs incurred for this are to be borne by the User.<\/span><\/p><p><b>5. Accessibility<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">The content is not designed to be accessible within the meaning of the Equal Treatment Act or the Accessibility Act. Due to the size of the company, there is no legal obligation to implement accessibility.<\/span><\/p><p><b>6. Duties and Responsibilities of Users<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">6.1. All information provided during registration must be complete and truthful.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">6.2. If there are reasonable doubts as to the accuracy of the data, the User must, upon first request by BOGNER Academy, provide documents proving their identity (e.g., copy of ID card, business license, etc.).<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">6.3. Users are obliged to keep their login credentials and password for the account secure and not to share them with third parties.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">6.4. Users are obliged to keep the data stored in their account up to date. If the data changes, it can be supplemented or modified in the account settings.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">6.5. If a User has reasonable suspicion that an illegality or rights infringement has occurred, they are obliged to inform BOGNER Academy.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">6.6. The User is obliged to inform BOGNER Academy without delay if regular communications (e.g., invoices) or other messages are not received within the usual time frame.<\/span><\/p><p><b>7. Blocking, Deactivation, and Revocation of Access Rights<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">7.1. BOGNER Academy is entitled to refuse acceptance of the registration request and thereby the conclusion of the user agreement without stating reasons.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">7.2. BOGNER Academy reserves the right to block, deactivate, or close a user account if the User or third parties with access to the user account violate applicable law or the contractual agreement. A violation exists in particular if a User registers with a false identity (fake account) or shares login credentials with third parties.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">7.3. If the User culpably provides incorrect or incomplete data, BOGNER Academy reserves the right to terminate the contract without notice with immediate effect and to assert claims for damages.<\/span><\/p><p><b>8. Changes to the Content of BOGNER Academy<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">8.1. The free services of BOGNER Academy are continuously adapted, optimized, and changed. The same applies to the content of the portals. There is no entitlement to specific content.<\/span><\/p><p><b>9. Rights of Use<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">9.1. BOGNER Academy grants the User a simple right of use to utilize the acquired content for the agreed period.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">9.2. The storage of free content or its integration into other or own databases is not permitted. Likewise, reproduction or use for commercial purposes is only permitted for personal use, otherwise prohibited, unless a separate written agreement has been concluded.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">9.3. Excluded from the right of use are market and price data as well as editorial content of third parties, insofar as these are protected by copyright.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">9.4. Any public disclosure, editing, distribution, or other use of the content \u2013 in whole or in part \u2013 requires the prior express written consent of BOGNER Academy.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">9.5. The user agreement runs for an indefinite period and may be terminated at any time by either party for the free content. Transfer of rights of use to third parties is excluded.<\/span><\/p><p><b>10. Consumer Right of Withdrawal<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">10.1. Withdrawal Instructions<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">You have the right to withdraw from this contract within 14 days without giving any reason.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">The withdrawal period is 14 days from the day of contract conclusion.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">To exercise your right of withdrawal, you must inform us (BOGNER Academy GmbH, Peter-Behrens-Platz 10, 4020 Linz, or by email: <\/span><a href=\"mailto:widerruf@bogneracademy.com\"><span style=\"font-weight: 400;\">widerruf@bogneracademy.com<\/span><\/a><span style=\"font-weight: 400;\">) by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">You may use the attached model withdrawal form, but it is not mandatory.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period has expired.<\/span><\/p><p><b>11. Consequences of Withdrawal<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a different delivery method than the cheapest standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise. In no case will you be charged any fees for this reimbursement.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">End of withdrawal instructions.<\/span><\/p><p><b>11.1. Exceptions to the Right of Withdrawal<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">There is no right of withdrawal for the supply of digital content not stored on a physical data carrier if BOGNER Academy<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">\u2013 has begun delivery with the express consent of the consumer,<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">\u2013 combined with the consumer\u2019s acknowledgment of the loss of the right of withdrawal in the case of early commencement of contract performance, and<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">\u2013 after provision of a copy or confirmation and before the expiry of the withdrawal period has begun delivery.<\/span><\/p><p><b>12. Community and User-Generated Content<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">12.1. If the User posts their own content on the portals of BOGNER Academy (e.g. texts, chart analyses, photos, videos), they agree that the content posted in this way may be reproduced, distributed, and publicly displayed on the internet free of charge. Furthermore, the User declares that they hold all copyrights and other rights to the posted content. If a commercial user wishes a different arrangement, a separate written agreement is required in any case.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">12.2. The User undertakes to comply with legal requirements for all content posted on the portals of BOGNER Academy. In particular, the User undertakes not to post illegal, grossly offensive, harmful to minors, or otherwise criminal content. Posting advertising content and advertising of any kind is, subject to other provisions, completely prohibited.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">12.3. The User shall indemnify BOGNER Academy upon first request from all claims and costs of third parties \u2013 including the legal costs necessary for defense \u2013 insofar as these are based on culpable violations of these Terms of Use, the GTC, or on missing rights to content posted by the User.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">12.4. BOGNER Academy will inform the User immediately in the event of a claim by third parties and give them the opportunity to comment. The User is obliged to provide BOGNER Academy with all information and documents required for defense.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">12.5. Insofar as Users publish content in discussion forums, streams, chats, or blogs and provide advice or tips on DeFi or investments there, this content is solely the responsibility of those Users. BOGNER Academy merely provides the technical platform and assumes no responsibility for their correctness, accuracy, or reliability. In particular, BOGNER Academy is not liable for losses or damages resulting from a User relying on such information.<\/span><\/p><p><b>13. Participation in Affiliate Programs, Sponsorship<\/b><span style=\"font-weight: 400;\"><br \/><\/span><\/p><p><span style=\"font-weight: 400;\">13.1. BOGNER Academy reserves the right to monetize references to (web)sites and offers of third parties through so-called affiliate links or to mark content as sponsored in partnership.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">13.2. In these cases, BOGNER Academy points out that direct or indirect compensation takes place \u2013 either in the form of commission-based participation (behavior-dependent) or as a flat fee (behavior-independent).<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">13.3. BOGNER Academy clearly marks corresponding affiliate links for the User. Ein Versto\u00df liegt insbesondere vor, wenn sich ein Nutzer mit einer falschen Identit\u00e4t registriert (Fake-Account) oder Zugangsdaten an Dritte weitergibt.<\/span><\/p><p><span style=\"font-weight: 400;\">7.3.<\/span> <span style=\"font-weight: 400;\">Falls der Nutzer schuldhaft unrichtige oder unvollst\u00e4ndige Daten mitteilt, beh\u00e4lt sich BOGNER Academy die au\u00dferordentliche K\u00fcndigung des Vertrages mit sofortiger Wirkung und die Geltendmachung von Schadensersatzanspr\u00fcchen vor.<\/span><\/p><ol start=\"8\"><li><b><\/b> <b>\u00c4nderungen der Inhalte von BOGNER Academy<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">8.1.<\/span> <span style=\"font-weight: 400;\">Das kostenlose Angebot von BOGNER Academy wird fortlaufend angepasst, optimiert und ver\u00e4ndert. Gleiches gilt f\u00fcr den Inhalt der Portale. Es besteht kein Anspruch auf bestimmte Inhalte.<\/span><\/p><ol start=\"9\"><li><b><\/b> <b>Nutzungsrechte<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">9.1.<\/span> <span style=\"font-weight: 400;\">BOGNER Academy r\u00e4umt dem Nutzer eine einfache Werknutzungsbewilligung zur Nutzung der erworbenen Inhalte f\u00fcr den vereinbarten Zeitraum ein.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">9.2.<\/span> <span style=\"font-weight: 400;\">Die Speicherung von kostenfreien Inhalten oder deren \u00dcbernahme in andere oder eigene Datenbest\u00e4nde ist nicht gestattet.
