Terms of Use of BOGNER Academy GmbH

The following Terms of Use define the framework for the content offered by Bogner Academy GmbH (hereinafter referred to as "BOGNER Academy") and apply to all services provided by BOGNER Academy on the website [] and on the portal [].
1. Registration

1.1. Registration is required to use the services offered by BOGNER Academy.
1.2. Registration and the use of a user account are free of charge unless otherwise indicated.
1.3. Registration is permitted for individuals aged 18 or older with full legal capacity, as well as for legal entities and partnerships.
1.4. Only one natural person may register per user account (e.g., no shared accounts for couples, companies, or teams).
1.5. After providing the required registration data, an activation email will be sent to the email address provided by the user.
1.6. The activation link is only valid for a limited time. If the user does not activate within the specified time period, the registration will be canceled free of charge.
1.7. The user confirms the registration by clicking the confirmation link in the registration email. Once registration is complete, a usage agreement with BOGNER Academy is established.

2. User Account

2.1. Users can log into their account at www.bognerdefiacademy.com.
2.2. The login credentials consist of the user’s email address and a personal password, which can be changed at any time.
2.3. Users can update their personal information at any time via the profile settings.
2.4. Users may delete their account at any time using the designated settings.
2.5. It is not possible to create multiple accounts with the same email address.
2.6. The user account provides access to the free content on the platforms.

3. Technical Requirements

3.1. An internet-enabled device is required to use the services of BOGNER Academy.
3.2. To use the platforms, a stable internet connection with average bandwidth, such as required for video streaming (at least 10 Mbit/s), is necessary.
3.3. The platforms can be used with common browsers such as Google Chrome, Mozilla Firefox, and Microsoft Edge. If display issues occur, the recommended browser is Google Chrome.
3.4. The platforms can also be accessed using a mobile browser, although this is not recommended.
3.5. To access certain materials or articles as "ePapers" or PDFs, the latest version of Adobe Reader by Adobe Systems Inc., or a comparable program capable of viewing and saving PDF files, is required.
3.6. The user is responsible for setting up the above-mentioned technical requirements. These are not included in the services provided by BOGNER Academy. Any resulting costs are the sole responsibility of the user.

4. Accessibility

The content is not designed to be accessible within the meaning of the Equal Treatment Act for Persons with Disabilities or the Accessibility Act. Due to the company’s size, there is no legal obligation to implement accessibility measures.

5. User Cooperation and Diligence Obligations

5.1. All registration information must be complete and truthful.
5.2. If there is justified doubt as to the accuracy of the data, the user must, upon first request by BOGNER Academy, provide documentation confirming their identity (e.g., a copy of an ID card, business license, etc.).
5.3. Users are obligated to store their login credentials and password securely and not share them with third parties.
5.4. Users are obligated to keep their account data up to date. If any data changes, it can be updated in the account settings.
5.5. If a user has a reasonable suspicion of illegality or a legal violation, they are obligated to inform BOGNER Academy.
5.6. The user must notify BOGNER Academy immediately if regular communications (e.g., invoices) or other messages are not received within the usual time frame.

6. Blocking, Deactivation, and Revocation of Access Authorization

6.1. BOGNER Academy reserves the right to reject any registration request and thereby refuse to conclude the usage agreement, without providing reasons.
6.2. BOGNER Academy reserves the right to block, deactivate, or terminate a user account if the user or third parties with access to the account violate applicable law or the contractual agreement. A violation exists in particular if the user registers with a false identity (fake account) or shares login credentials with third parties.
6.3. If the user provides false or incomplete data negligently, BOGNER Academy reserves the right to terminate the contract without notice and to claim damages.

7. Changes to the Content Provided by BOGNER Academy

7.1. The free content offered by BOGNER Academy is continuously adapted, optimized, and changed. The same applies to the content of the platforms. There is no entitlement to specific content.

8. Rights of Use

8.1. BOGNER Academy grants the user a non-exclusive license to use the acquired content for the agreed period.
8.2. The storage of free content or its integration into other or own data collections is not permitted. Likewise, reproduction or use for commercial purposes is only permitted for personal use, and otherwise prohibited unless a separate written agreement has been concluded.
8.3. Market and price data as well as editorial content from third parties are excluded from the right of use, insofar as they are protected by copyright.
8.4. Any public access, editing, distribution, or other use of the content – in whole or in part – requires the prior express written consent of BOGNER Academy.
8.5. The usage agreement is concluded for an indefinite period and may be terminated at any time by either party with respect to free content. The transfer of usage rights to third parties is excluded.

9. Right of Withdrawal for Consumers

10. Withdrawal Instruction

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (BOGNER Academy GmbH, Peter-Behrens- Platz 10, 4020 Linz, or via email: termination@bogneracademy.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email).
You may use the attached model withdrawal form, although it is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

11. Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal.
We will carry out the reimbursement using the same means of payment that you used for the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged any fees for this reimbursement.

11.2. Exceptions to the Right of Withdrawal

There is no right of withdrawal for the delivery of digital content not stored on a physical medium, if BOGNER Academy
– has begun delivery with the express consent of the consumer,
– in conjunction with the consumer’s acknowledgment of the loss of the right of withdrawal upon early commencement of contract fulfillment, and
– after providing a copy or confirmation and before the withdrawal period has expired.

12. Community and User-Submitted Content

12.1. If the user uploads their own content to BOGNER Academy’s platforms (e.g., texts, chart analyses, photos, videos), they agree that such content may be reproduced, distributed, and publicly displayed on the internet free of charge. The user also declares that they hold all copyrights and other rights to the uploaded content. If a commercial user requires a different arrangement, a separate written agreement is required in all cases.
12.2. The user agrees to comply with all legal requirements when posting content on BOGNER Academy platforms. In particular, the user agrees not to post unlawful, grossly offensive, harmful to minors, or otherwise criminal content. The posting of promotional or advertising content of any kind is strictly prohibited, unless otherwise authorized.
12.3. The user shall indemnify BOGNER Academy upon first request from all claims and costs of third parties – including legal fees necessary for legal defense – if such claims result from culpable violations of these Terms of Use, the General Terms and Conditions, or from missing rights to the content uploaded by the user.
12.4. In the event of third-party claims, BOGNER Academy will promptly inform the user and give them the opportunity to comment. The user is obligated to provide BOGNER Academy with all information and documents required for defense.
12.5. Where users publish content in discussion forums, streams, chats, or blogs and provide advice or tips regarding DeFi or investments, such content is solely the responsibility of those users. BOGNER Academy merely provides the technical platform and assumes no responsibility for the correctness, accuracy, or reliability of such content. In particular, BOGNER Academy is not liable for any losses or damages resulting from reliance on such information.

13. Participation in Affiliate Programs and Sponsorships

13.1. BOGNER Academy reserves the right to monetize references to third-party (web) pages and offerings via so-called affiliate links or to label content as sponsored in the context of partnerships.
13.2. In such cases, BOGNER Academy will disclose that direct or indirect compensation is received – either in the form of performance-based commissions or as a flat fee (not performance-based).
13.3. BOGNER Academy clearly marks relevant affiliate links for the user. Upon request, BOGNER Academy will provide further information about the type and structure of the compensation.
